On the eve of first national constitution day, Chinese president, also general secretary of CPC central committee, president of the Military Commission of CPC central committee Xi Jinping made critical remarks. He stressed that the Constitution is the highest law of the country and it embodies the will of the Party and the people. Practices prove that our Constitution is in line with the country's conditions, reality and the times... it's also the basic legal guarantee for the nation and its people to endure various difficulties, risks and tests and follow the socialist path with Chinese characteristics. Governance and administration by constitution is prior to governance and administration by rule of law. He calls for combining CPC’s guidance, people as the leader of the country and governance under rule of law, upholding the socialist road under rule of law with Chinese characteristics and protecting the authority of law. He said the Constitution Day is an effort to "bring the spirit of the Constitution deeper into people's hearts" and make it their "common belief”, further promotion of the Constitution among the public and its comprehensive implementation to boost social justice and people's livelihoods on a higher level."

The State Council Legislation Department seeked public opinions on Residence Permit Regulations(Draft). The draft specified that residence permit holders will enjoy equal rights including free compulsory education, equal employment as the registration holders and gradually enjoy equal rights including medium vocational education funds, employment assistance, housing protection, services for the elder, social welfare, social aids, and the qualifications for children of the residence permit holders to attend the high school entrance exam and college entrance exam.

The Twelfth China-Germany Human Rights Talks was held in Berlin on Dec.4. Director-General of the Department of International Affairs of the Foreign Ministry Li Junhua and commissioner of Human Rights Affairs of Germany Federal Chancellor Rodney Strasser jointly held the meeting.[page]

The Supreme People's Procuratorate released three regulations on law procedures, suing and petition including People's Procuratorate’s regulations of cases on accusation and appeal listed into law procedures by law, People's Procuratorate’s regulations on judicial flaws (pilot) and People's Procuratorate’s terminal regulations on accusation and suing cases to protect litigant’s accusation and appeal rights by law and guarantee to solve people’s reasonable and legal appeal in time and justice.

The 33th China-Europe Dialogue on human rights was held in Brussels on December 8th. Both sides exchanged views on human rights values and discussed major issues such as international human rights cooperation and women rights.

The Chinese side presented a comprehensive introduction to China’s progress in various fields of human rights, in particular the decision adopted at the 4th Plenary Session of the 18th CPC Central Committee to comprehensively promote the rule of law, hoping that Europe could view China’s progress in human rights objectively on equal and respectful principle and that the two countries could enhance mutual understanding and respect through sincere communication and carry out constructive cooperation. The Chinese side also expressed concerns over issues confronting Europe including Roma, the protection of women’s rights and other aspects.

Li Junhua said on the press conference that human rights promotion and perfection will be a long process during which we would like to hear kind and constructive advices from all sides and absorb it based on China’s national conditions. At the meantime, we can tell European friends we are confident of promoting China’s human rights and we have found the road and style in accordance with China’s national conditions on which we are extremely certain.Sabatier said both sides have deepened mutual understandings and discussed future cooperation through this dialogue.[page]

The second International Seminar on Human Rights and Museology was opened in Beijing this morning. Huang Mengfu, former vice chairman of CPPCC, also chairman of China Foundation for Human Rights Development and Cui Yuying, vice minister of the State Council Information Office attended the opening ceremony and delivered speeches. More than 40 museum heads and experts from home and abroad including Russia, Ukraine, France, Italy, Belgium, Brazil, Egypt, Israel, Japan, South Korea, Malaysia, Myanmar, Philippine attended the seminar and discussed about issues like peaceful development and promoting human rights progress.

Co- hosted by China Foundation for Human Rights Development and the Museum of the War of Chinese People’s Resistance against Japanese Aggression, the two-day seminar centers on the theme “Learning from history, cherishing peace, and safeguarding human rights,” and discusses the following topics: historical lessons from World War two and their inspirations on the world’s human rights cause, maintain the fruits of the world anti-Fascist war victory, a common responsibility of nations and strengthening international exchanges, forming a joint operational system, and making use of museums to carry out education on opposing war and protecting human rights.

Poverty alleviation is significant to overall development, which calls for the whole party’s high-profile. It is necessary to make children from poor family to enjoy the fair and qualified education. Economy shall be developed properly and with characteristics. Public service and poverty alleviation and aids shall be better supported and focused.

China attaches great importance to improving and protecting human rights. To guarantee 1.3 billion people's right to subsistence and development has always been on the top of our priority. We have been working vigorously to promote economic and social development, elevate people's living standards in an all-round way, steadily move forward the build-up of democracy and rule-of-law, and earnestly implement the constitutional principle that the state respects and guarantees human rights. As a result, the Chinese people are now enjoying a higher level of human rights at every metric. The 3rd and the 4th plenary sessions of the 18th CPC Central Committee laid out strategic plans respectively for comprehensively deepening reform and pushing forward the governance of the state by rule-of-law, which charted the course and drew the blueprint for China's future development, and again demonstrated China's confidence and resolve to improve and protect human rights.It is China's long-standing position to carry out constructive dialogue and cooperation in the field of human rights on the basis of equality and mutual respect. We have been engaging in human rights dialogue and communication with various countries so as to enhance understanding and narrow differences. China has been playing a positive role in participating in the UN human rights endeavors and opposed to politicizing human rights issue and adopting double standards. The seminar on the 66th anniversary of The Universal Declaration of Human Rights opened in law school of Renmin University of China. Scholars and experts from China Society for Human Rights Study, Party School of the Central Committee of CPC, China’s Academy of Social Sciences, China’s University of Political Science, People’s Public Security University of China, human rights magazine and chinahumanrights.org attended the seminar which centers on The Universal Declaration of Human Rights--realize the common goal: UN human rights protection and China.

Vice president of China Society for Human Rights Study Chen Shiqiu, researcher of international law center of China’s Academy of Social Sciences Zhu Xiaoqing, vice researcher Huang Jinrong, vice professor of constitution and politics center of China’s University of Political Science Liu Xiaonan, professor Zhu Liyu from law school of Renmin University of China, and instructor Hua Guoyu from People’s Public Security University of China all made theme speeches on the conference. The conference also set Dec.3-Dec.10 of every year as constitution and human rights week of law school of China’s University of Renmin University.

The Ministry of Education released the notice that deploy the employment and starting up of 2015’s school graduates . The notice required school all over the country to prompt innovative education of starting up and self starting up work, expand investment for university students’ starting up. Universities shall build flexible educational system and allow the students in schools to suspend schooling for starting up.

Ministry of Foreign Affairs spokesman Hong Lei said the people of a country is best positioned to speak about a country's human rights conditions. The US has no right to pose as referee and willfully hurl irresponsible remarks at other countries' human rights records.Our piece of advice for the US side is to earnestly reflect upon and address its own human rights issue, and stop making groundless accusation against China.

Central Committe of CPC, National People’s Congress, The State Council, and Military Commission of CPC central committee held the state ceremony for China's first National Memorial Day for Nanjing Massacre Victims in Nanjing. Chinese president Xi Jinping attended the ceremony and made important remarks. The ceremony was presided over by Zhang Dejiang, chairman of the Standing Committee of the National People's Congress (NPC).[page]

Xi Jinping made inspection tour to villages, farmers’ home, enterprises, science research centers and exchanged ideas with cadre and citizens during his visit to Nanjing and Zhen Jiang. The 36th Chairman meeting of the 12th NPC Standing Committee was held in the Great Hall of the People. The meeting will review the draft of Waterway law, revised draft of food security law, legislation law, and ads law, proposal of national security law(draft) raised by Chairman meeting of  NPC Standing Committee, proposal of overseas NGOs regulations(draft) and Air Pollution Prevention and Treatment (Revised draft), decisions on holding the 3rd session of the 12th NPC meeting raised by NPC Standing Committee.

Huugjilt’s parents received the verdict of Huugjilt from the Inner Mongolia Autonomous Regional Higher People's Court. Huugjilt was absolved.

Huugjilt, who was 18 at the time, was found guilty of raping and murdering a woman in a public toilet in Hohhot on April 9, 1996. After Huugjilt was sentenced to death and executed, another alleged serial rapist and killer, Zhao Zhihong, confessed to the murder after he was arrested in 2005.
 On November 20th, the Inner Mongolia Autonomous Regional Higher People's Court announced to started a new trail for Huugjilt’s case after examining the appeal of this case.

These two documents will improve study level examination of ordinary high school students and its authority and public credibility, regulate the evaluation of comprehensive quality to fulfill  procedure transparent and content credible.[page]

The State Council released guideline on promoting the development of philanthropy. The guideline called for opening more donation channels, emphasizing the development of Internet philanthropy. It also called on social forces such as public institutions and media outlets to provide more support for philanthropy.It urged charitable organizations to improve management standards and enhance their credibility, vowing to punish those who willfully dishonor charitable organizations and hurt their reputation.According to the guideline, the central authorities are planning an information-sharing system capable of better coordinating relief efforts for government agencies and non-governmental organizations.

Ministry of Foreign Affairs spokesman Hong Lei said on the regular press conference that if you want to compare the human rights records of China and the US, I can tell you that no one is perfect in terms of human rights. China has self-knowledge. We will not act like a human rights preacher in front of other countries.

Composed of 50 ministrys and commissions including the State Council Information Office and Ministry of Foreign Affairs,the united conference of the National Human Rights Action Plan started mid-term evaluation of the National Human Rights Action Plan. "For two years, under the leadership of president Xi Jinping and the process of realizing the Chinese Dream, China has been working effectively toward goals set by the National Human Rights Action Plan and made considerable progress in human rights protection," said Cai Mingzhao, director of the State Council Information Office (SCIO) at an interim review meeting on the action plan.

In the past two years, Chinese people’s livelihood has been steadily improved and citizens have enjoyed more extensive civil rights and freedom. Legislation protection of human rights as well as human rights protection system of women, children, seniors, and the disable have been better improved. Human rights education training and education and international exchange have made transparent achievements.[page]

China will reform its pension system for staff in government, Party bodies, and public institutions, Vice Premier Ma Kai said in a report to the top legislature on Tuesday.Ma delivered a report about China's social security system at the ongoing bi-monthly session of the National People's Congress (NPC) Standing Committee, saying the reform will establish the same pension system with urban employees.

The Supreme people's court, the Supreme People's Procuratorate and Civil Affairs Bureau jointly released major opinions on dealing with guardians violating teenagers’ rights which includes 5 parts and 44 articles. It also specified seven kinds of serious harming behaviors of guardians including sexual abuses, selling children, and violent abuses. Those guardians who violated these rules will be cancelled the right of guardian. The opinions will take effect on Jan 1st , 2015.

Ministry of Human Resources and Social Security, Ministry of Finance and National Health and Family Planning Commission of the PRC jointly released guidelines on better promoting disbursement and settlement of distance medical treatment fees by basic medical insurance which specifies the medical treatment fees of the retired settled in different provinces will be comprehensively fulfilled according to the Ministry of Human Resources and Social Security.
