Abstract: The establishment and protection of the right to development of persons with disability is not only an important part of Xi Jinping‘s thought on human rights, but also a reflection of Marxist ideas of human rights, and an essential requirement of comprehensively promoting the rule of law in China. We should promote the protection of the right to development of persons with disabilities in terms of affirmative action by eliminating the formalistic concept of equality and seeking essential equality. The Chinese government‘s affirmative action has structural characteristics, including providing an institutional basis for affirmative action by constructing legal and non-legal institutions, providing a favorable environment for affirmative action by shaping a friendlier social ecology for protecting the right to development of persons with disabilities, and providing vigorous guarantees for affirmative action by intensifying the government‘s affirmative responsibility.
